Shiney Ahuja case: Medical report confirms rape

 A medical examination of the domestic help who has accused actor Shiney Ahuja of rape has revealed that she may have been forced into having vaginal intercourse. An X-ray test also revealed that she could be only 17 to 18 years of age.
After the maid lodged her complaint with the Oshiwara police on Sunday, the police sent both Ahuja and the victim for medical examinations at the Nagpada Police Hospital late on Sunday night.
Medical experts revealed that there are injuries to the girl’s private parts, which indicate that she may have been forced into having intercourse. A doctor said there was a tear in her hymen, indicating fresh intercourse. Doctors said there are no other injury marks on the girl’s body. She is likely to be given a urine test at a later stage to check if she is pregnant.
In another major development, an X-ray test that measures bone ossification has revealed that the girl could be just 17 to 18 years of age. If she is below 18, that would make her a minor. However, a statutory rape charge — when even consensual sex is rape — can only be slapped if the victim is younger than 16.
Police surgeon, Dr S M Patil, of Nagpada Police Hospital, said that these medical findings are very important and could prove to be crucial evidence. Meanwhile, swabs and a smear from the girl’s private parts have been sent for chemical analysis to the State Forensic Science Laboratory, Kalina, sources said.
The girl’s blood samples have also been sent to the lab as authorities want to determine if she was forcibly made to consume any drugs or alcohol.
A medical exam on Ahuja did not reveal any injuries on his body, an official said. A glans wash and blood samples have been sent to the forensic laboratory for chemical analysis, sources said. Police want to determine if Ahuja was inebriated at the time of the alleged incident.
